Introduction

Welcome to Reviuly. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to all of these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Reviuly reserves the right to update or change these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Description of Service

Reviuly is a testimonial collection, management, and display platform that enables businesses, freelancers, coaches, and creators to collect text and video testimonials from customers via shareable links and QR codes, manage and approve testimonials through a dashboard, display testimonials via embeddable widgets and Wall of Love pages, and automate review requests.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of it at any time.

User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and notify us immediately of any unauthorised use of your account.

You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement.

User Content

You retain ownership of any testimonials, reviews, images, and other content you or your customers submit through the Service ("User Content"). By submitting User Content, you grant Reviuly a non-exclusive, royalty-free, worldwide licence to store, display, and process that content solely to provide the Service.

You are solely responsible for ensuring that you have the right to collect and display testimonials from your customers; testimonials are genuine and not fabricated or deceptively incentivised; User Content does not violate any applicable law, including the Indian IT Act 2000 and Consumer Protection Act 2019; and User Content does not infringe any third-party intellectual property rights.

Reviuly reserves the right to remove any User Content that violates these Terms.

Prohibited Uses

You agree not to use the Service to:

• Post false, misleading, or fabricated testimonials
• Harass, abuse, or harm any individual
• Violate any applicable local, national, or international law or regulation
• Collect testimonials without the knowledge or consent of the reviewer
• Attempt to gain unauthorised access to any part of the Service
• Use automated tools to scrape, copy, or distribute Service data without permission
• Impersonate any person or entity
• Engage in any activity that interferes with or disrupts the Service

Billing & Payments

Reviuly offers a free tier and paid subscription plans billed in Indian Rupees (INR) via Razorpay. By subscribing to a paid plan, you agree to pay all applicable fees as described on the Pricing page at the time of subscription, provide valid payment information and keep it up to date, and allow Reviuly to automatically charge your payment method on a recurring basis.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your account dashboard. Refunds are not provided for partial billing periods except as required by applicable law. We reserve the right to change pricing with at least 14 days' notice to existing subscribers.

Intellectual Property

The Reviuly name, logo, platform design, code, and all associated intellectual property are owned by Reviuly and are protected under applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without prior written permission. Any feedback or suggestions you provide may be used by Reviuly without any obligation to compensate you.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Reviuly, you consent to the collection and use of information as described in our Privacy Policy.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Reviuly does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, Reviuly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to Reviuly in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or if required to do so by law. You may terminate your account at any time by contacting us at hello@reviuly.com. Upon termination, your right to use the Service ceases immediately. Your data will be handled as described in our Privacy Policy.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will update the "Last updated" date below and notify registered users via email. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
